Terms of Service

1. Acceptance

By using driftvoy.com or any service we provide, you agree to these terms. If you don't agree, don't use the site or our services.

If you sign up for our waitlist or, after launch, buy a Driftvoy travel eSIM plan, you confirm that you are at least 18 years old and that the information you provide is accurate.

2. About Driftvoy

Driftvoy LLC ("Driftvoy", "we", "us") is a Wyoming-registered (USA) reseller of prepaid mobile data plans for travelers. We do not own or operate telecommunications infrastructure. We purchase wholesale mobile data from licensed upstream connectivity providers and resell it under the Driftvoy brand.

This is standard for the travel eSIM industry — Airalo, Holafly, Saily, Nomad, and most travel eSIM brands operate the same way.

3. Current status — pre-launch

As of the "Last updated" date above, Driftvoy is preparing for commercial launch. The site currently displays our planned travel eSIM plans, pricing, customer policies, and product terms; the actions available today are joining the waitlist and contacting us. Banking and payment processing must be set up before checkout goes live. Public launch is currently targeted for September 2026.

Until launch, any pricing shown on the site is indicative — final pricing at launch is governed by the published catalog at the time of purchase.

4. Eligibility

You may use the site and (after launch) buy plans only if:

  • You are at least 18 years old
  • You are not located in, or a resident of, a country sanctioned under US OFAC (Russia, Belarus, Iran, North Korea, Syria, Cuba, Crimea/DNR/LNR regions of Ukraine)
  • You will use the service for personal travel data — not for resale, M2M, IoT fleets, or any prohibited use listed in our Refund Policy & Acceptable Use page

If we determine you don't meet eligibility, we may refuse service and decline to provision plans for you.

5. Account and information

We don't currently offer customer accounts. After launch, purchases are tied to your email address. You are responsible for the security of the email account you use, including for receiving your eSIM QR code.

You agree to provide accurate information. If we discover that information you provided is materially false (for example, fraudulent purchase, false identity, billing address fraud), we may cancel orders, withhold refunds for AUP violations, and refuse future service.

6. Pricing, billing, and refunds

After launch:

  • All prices are in US dollars. Local currency conversion is performed by your card issuer.
  • Plans listed on the site are the prices you will be charged at checkout. We don't add hidden fees or surprise charges.
  • Sales tax is calculated and shown at checkout based on your billing location. Most jurisdictions do not currently apply sales tax to our service, but we comply with applicable laws.
  • Refund eligibility is described in detail on the Refund Policy & Acceptable Use page. In short: full refund if your eSIM is never delivered or fails to activate; no refund after the eSIM has activated and used data.

7. Use of the site

You agree not to:

  • Scrape, copy, or systematically download content from driftvoy.com beyond ordinary browsing
  • Attempt to access non-public portions of the service, reverse-engineer our APIs, or interfere with our infrastructure
  • Submit false or fraudulent waitlist signups, contact form messages, or (after launch) purchases
  • Use the site or our services for any unlawful purpose, including fraud, money laundering, or evasion of sanctions
  • Resell, sublicense, or transfer Driftvoy eSIM plans (after launch) to third parties without our written consent
  • Use Driftvoy eSIMs in SIM farms, M2M fleets, IoT bulk deployments, or any non-human-driven application

8. Intellectual property

The Driftvoy name, logo, site design, content, illustrations, and code are owned by Driftvoy LLC or licensed to us. You may not copy, redistribute, or use them commercially without our written permission.

You retain ownership of anything you submit (such as a contact form message). By submitting it, you grant us a non-exclusive license to use it for the purpose of replying and operating the service.

Third-party trademarks mentioned on the site (Airalo, Holafly, Saily, Nomad, Apple, Google, etc.) belong to their respective owners. We use them only for honest comparison or compatibility reference.

9. Disclaimers

The site and (after launch) the services are provided "as is" and "as available". To the maximum extent permitted by law, we disclaim all warranties — express, implied, or statutory — including warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation.

Specifically:

  • We do not guarantee that the site will be available at all times
  • We do not guarantee that information on the site is current — we update prices and plan details when the underlying wholesale catalog changes
  • After launch, network performance (speed, coverage, reliability) is determined by the underlying carrier (KDDI/Softbank in Japan, AIS/True in Thailand), not by Driftvoy
  • We do not guarantee coverage in remote areas where the carrier's network does not reach

10. Limitation of liability

To the maximum extent permitted by law:

  • Our total liability to you for any claim arising from the site or services is limited to the greater of (a) the amount you paid us in the 12 months before the claim, or (b) US $50
  • We are not liable for indirect, incidental, consequential, special, or punitive damages — including lost profits, lost data, business interruption, or substitute service costs — even if we were advised of the possibility
  • We are not liable for any failure or delay caused by events outside our reasonable control (carrier outages, government action, internet disruption, force majeure)

Some jurisdictions don't allow these limitations. In those jurisdictions, our liability is limited to the maximum extent permitted by applicable law.

11. Indemnification

You agree to defend, indemnify, and hold harmless Driftvoy LLC, its officers, employees, and contractors from any claim, loss, or expense (including reasonable attorneys' fees) arising from:

  • Your use of the site or services in violation of these terms
  • Your violation of any law or third-party right
  • Information you submitted that turns out to be false or fraudulent

12. Governing law and disputes

These terms are governed by the laws of the State of Wyoming, USA, without regard to its conflict of laws principles.

Any dispute arising from these terms or your use of the service will be resolved exclusively in the state or federal courts located in Wyoming. You consent to the jurisdiction of those courts.

You agree to bring any claim individually — not as part of a class action, collective action, or representative proceeding. If a court finds the class action waiver unenforceable in your jurisdiction, the rest of this dispute resolution section remains in force.

13. Changes to these terms

We may update these terms from time to time. The "Last updated" date at the top reflects the most recent change.

For material changes (changes to refund policy, AUP, pricing model, or dispute resolution), we will notify everyone on the waitlist by email at least 30 days before the change takes effect. Continued use of the site after the effective date constitutes acceptance.

14. Termination

We may suspend or terminate your access to the site or (after launch) cancel orders if we believe you have violated these terms, our Acceptable Use Policy, or applicable law. Where the violation is material (fraud, sanctions evasion, AUP violation), we may do so without notice and without refund.

You may stop using the site at any time. You may unsubscribe from emails using the link in every email or by writing to service@driftvoy.com.

15. Severability and entire agreement

If any provision of these terms is found unenforceable, the remaining provisions remain in effect.

These terms, together with the Privacy Policy, Refund Policy & Acceptable Use page, and Cookie Policy, constitute the entire agreement between you and Driftvoy regarding the site and services. They supersede any prior agreements on the same subject.
